Women on average make only 77 cents to every dollar earned by men. Some of that wage gap is the result of women being more likely to work in certain industries or occupations, but about 40 percent of the difference in men’s and women’s wages cannot be explained by any measurable factor. And the wage gap is even higher for women of color, pointing to social factors that go far beyond the choices that women make.

The National Mediation Office is the authority with responsibility for wage statistics in the country. According to their report from September 2010, women during 2009 earned 14.8% less than men. That's the total so-called wage disparity and that's for the entire labour force, both public and private employees, both blue collar and white collar workers.
But a disparity in average wages does not mean that women and men are paid differently for the same job. There are a great many factors that explain why the average wage is higher for men. The most important factor is that there are very big differences in choice of career - men more often will choose careers with high salaries and women often choose careers with low salaries. It's important to stress that this is their choice.
But there are further factors that explain the disparity. Some of these are:
Unused daily work time
Number of years experience
Nature of the work
Level of difficulty
Managerial position or not
Education
Experience
Level of enthusiasm, flexibility, eagerness to sacrifice, etc.
...
So there is no basis for any debater to claim to know that the remaining 'inexplicable wage disparity' is caused by discrimination against women.

Under the Equal Pay Act, the law that makes it illegal for employers to pay unequal wages to men and women who perform substantially equal work, an individual subject to wage discrimination must establish that “(1) the employer pays different wages to employees of the opposite sex; (2) the employees perform equal work on jobs requiring equal skill, effort and responsibility; and (3) the jobs are performed under similar working conditions.”[1] Even if the individual makes each of these showings, the defendant employer may avoid liability by proving that the wage disparity is justified by one of four affirmative defenses—that is, that the employer has set the challenged wages pursuant to “(1) a seniority system; (2) a merit system; (3) a system which measures earnings by quantity or quality of production; or (4) a differential based on any other factor other than sex.”
The Paycheck Fairness Act, like the Equal Pay Act, still requires employees to meet an exceptionally high burden before an employer need even offer an affirmative defense. An Equal Pay Act plaintiff must identify a comparable male employee who makes more money for performing equal work, requiring equal skill, effort, and responsibility under similar working conditions.
Even though the workforce is almost 50:50 male to female workers, 88% of men work full-time, whereas this is true for 58% of women.
This is why a direct comparison is meaningless – saying that on average men earn more tells us nothing unless we take hours worked into account. Thus, tables such as 'Gender pay gap for median and mean hourly earnings, excluding overtime' are more hard to interpret. With full-time workers being paid a higher hourly rate than part-time workers, and males making up the majority of full-time workers (61% of them), this will skew the average in their favor. An interesting side note is that in part-time work, where women make up the majority of the workforce, the pay-gap is reversed, with males trailing by 5%.
